The Legal Stuff:

Welcome to Trese Judd Art. These Terms and Conditions (“Terms”) govern your use of the tresejudd.com website and your purchase of original artworks from Trese Judd Art. Trese Judd Art (“we”, “us”, or “our”) is an independent contemporary acrylic artist selling only original physical artworks (one-of-a-kind paintings on canvas) to customers internationally. By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, please refrain from using the site all together. We aim to be fair and transparent – if you have any questions about these Terms, please contact us for clarification.

Orders and Payment:

  • Original Artwork Sales – All products listed for sale on Trese Judd Art are original, handmade, acrylic paintings. We do not sell prints, reproductions, or digital products of any kind. Each artwork is unique, so availability is limited to one per piece. Once an original painting is sold, it will be marked as unavailable.
  • Placing an Order -To purchase an artwork, add it to your cart and complete the checkout process. You may need to provide certain information like your name, shipping address, and payment details. Please ensure all information is accurate. After placing an order, you will receive an order confirmation via email. We reserve the right to decline or cancel an order (e.g. in case of pricing errors or unforeseen issues).  If we do so, we will notify you and issue a full refund promptly.
  • Pricing and Currency – All prices on the site are listed in U.S. dollars (USD) unless otherwise noted. The price shown at checkout is the final price of the artwork itself. Taxes and Duties: Depending on your location, additional sales tax, VAT, or import duties may apply to your order. Any such charges will be indicated during checkout or are the responsibility of the buyer at delivery (see Shipping below for international duties).
  • Payment – We accept all major credit cards and other standard payment methods (e.g. PayPal) for online purchases. Payment must be completed at the time of checkout. All transactions are processed through secure payment gateways to protect your information. We do not store full credit card numbers on our servers. 
  • Order Processing – After your payment is confirmed, we will prepare your artwork for shipment. Because each piece is original, we take care to handle and package the artwork safely before dispatch. Please allow us a few days to process and ship your order (painting may require special wrapping, protection, and pick-up scheduling). If there is any significant delay or issue in processing your order, we will contact you via email.

Shipping:

  • Worldwide Shipping: Trese Judd Art ships internationally. No matter where you are in the world, we will do our best to get the artwork to you. Shipping options and costs will be calculated at checkout based on your location. We currently ship from California, USA, and deliver to most countries. If your country is not available at checkout, please contact us to discuss possible arrangements.
  • Shipping Carriers and Timing: We use reputable shipping carriers (such as UPS, FedEx, DHL, or USPS for domestic shipments) to send our artworks. Once your order is shipped, you will receive a notification with a tracking number so you can monitor the delivery progress. Delivery times vary by destination: domestic (within the United States) deliveries typically arrive within 5–10 business days, while international deliveries may take 1–3 weeks or more depending on customs and carrier times. Please note that these are estimates and not guaranteed arrival dates.
  • Packaging: We take great care in packaging artworks to ensure they arrive safely. Paintings are wrapped with protective materials and cushioned in sturdy boxes or crates as appropriate. Insurance: All shipments include insurance for the value of the artwork. In the rare event of loss or damage in transit, please notify us immediately so we can initiate a claim with the carrier. (See Returns below for how to handle a damaged delivery.)
  • Customs, Duties, and Taxes: International shipments may be subject to import taxes, customs duties, or fees imposed by your country’s customs agency. These charges are not included in our item prices or shipping costs. The buyer/recipient is responsible for paying any such fees required to release the shipment upon arrival in your country. Unfortunately, we have no control over these government-imposed charges and cannot predict their amount. We recommend checking with your country’s customs office for information on potential fees before ordering.
  • Delivery and Signature: Our shipments often require a signature on delivery (especially for high-value original art) to ensure your painting is received securely. Please provide an address where someone can sign for the package during business hours. If no one is available and a delivery is missed, it is your responsibility to follow up with the carrier to arrange re-delivery or pick up.
  • Shipping Issues: If you encounter any problems with shipping (delays beyond the expected timeframe, tracking issues, etc.), please reach out to us. While we are not responsible for courier delays or errors, we will gladly assist in tracking the package and communicating with the carrier to resolve any issues. Your satisfaction is important, and we want your artwork to reach you as smoothly as possible.

Returns:

We want you to love your new artwork. If for any reason you are not satisfied with your purchase or the artwork arrives damaged, we offer a return policy as outlined below. Please read the following instructions carefully to ensure eligibility for a refund:

  1. Return Request Period (14 Days): Contact Trese Judd Art within 14 days of receiving your painting to request a return or report an issue. You can email us at returns@tresejudd.com with your order information, the title of the artwork, and the reason for return. We will respond with return instructions and a return authorization if applicable.
  2. Damaged Item Procedure: If the painting arrived damaged or defective, please include photographic evidence in your email. Specifically, provide clear photos of the damage to the artwork and the condition of the packaging at the time of delivery. This documentation is required so that we can verify the issue and file a claim with the shipping insurer. Please do not discard the packaging materials, as the courier may need to inspect them.
  3.  Return Shipping: After you contact us and your return is authorized, you must ship the artwork back within 7 days of receiving return approval. Ensure that the artwork is carefully repackaged in its original packaging (if possible) and is in the same condition you received itq. The painting should be secure to prevent any further damage in transit. We highly recommend using a trackable and insured shipping method for the return, as we cannot process a refund for an item we do not receive.
  4. Refund Process: Once we receive the returned artwork and confirm it is in acceptable condition, we will issue a full refund for the purchase price of the painting. Refunds will be made to the original payment method you used (credit card, PayPal, etc.). Please allow 7–10 business days from the time we receive the return for the refund to be processed. We will notify you via email when the refund has been issued. (Note: depending on your bank or credit card company, it may take additional time for the refund to appear on your statement.)

Return Shipping Costs:

Please note that the buyer is responsible for all return shipping and handling costs, unless the return is due to a major error on our part. We do not refund original shipping fees and return shipping costs will not be reimbursed. For international returns, please clearly mark the package as “Returned Artwork” to avoid unnecessary customs charges; we are not responsible for customs fees incurred on returns.

Exceptions:

We strive to be accommodating, but returns that fall outside of the 14-day contact window or 7-day return shipment window may not be accepted. Likewise, if a returned artwork is received significantly damaged (beyond any reported issue) or not in its original condition, we reserve the right to deny the refund or issue a partial refund. We will communicate with you in such cases.

Copyright:

All artworks, images, designs, and text on the Trese Judd Art website are protected by international copyright laws. Copyright © Trese Judd. Trese Judd (the artist) retains all intellectual property rights to her artworks and website content. This means that although you may purchase an original painting, the copyright and reproduction rights of the artwork remain with the artist. Purchasing an artwork gives you ownership of the physical canvas, not the right to copy, reproduce, or create derivative works from it.

In simpler terms, buying an original piece does not transfer its copyright to you. Trese Judd Art reserves all rights to the images and art, including the right to display, publish, or reproduce the artwork in any form (for example, in portfolios, on social media, or as prints, unless otherwise agreed in writing). Any use of the site’s content or the artwork images without permission is a violation of these Terms and may infringe upon copyright law.

Usage Restrictions:

Personal and Commercial Use: You are not allowed to use any images of the artwork or content from this website for any commercial or personal use unless explicit written permission is granted by us. This includes (but is not limited to) downloading images of artworks, copying or reposting images on social media or other websites, printing the images, or using them in any marketing material. All content on the site is provided solely for your personal viewing and shopping experience. No reproduction, distribution, or modification of the artwork images is permitted without prior permission.

Prohibited Uses: In using the Trese Judd Art website, you agree that you will not engage in any activities that are unlawful, infringe on our or others’ rights, or interfere with the site’s operation. Examples of prohibited behavior include attempting to reverse-engineer the website, attempting to bypass security measures, or using our content in a manner not authorized by these Terms. We reserve the right to restrict or terminate access for users who misuse our content or violate these Terms.

If you are an art collector or a fan who wishes to share an image of an artwork you purchased (for example, on social media or a blog), you must obtain our permission first. We generally welcome sharing when done with credit and consent, but you must email us for written permission. Unauthorized use of images or text from this site will be addressed seriously. Remember, the artist’s rights are protected by law, and infringement can have legal consequences.

Modifications to Terms:

Trese Judd Art reserves the right to update, change, or replace these Terms and Conditions at any time. We may revise the Terms to reflect changes in our practices, for legal reasons, or for any other operational purposes. If we make significant changes, we will post the updated Terms on this page with a new “Last Updated” date. Changes to the Terms become effective as soon as they are posted here.

It is your responsibility to review this page periodically for any updates. By continuing to use the site or purchase products after any modifications are posted, you agree to the revised Terms. If you do not agree with a change, you should discontinue use of the website and services. For any major changes, we may also attempt to notify registered customers via email, but posting updated terms on the site is the primary means of notification.
